ELIGIBILITY This Contest is open to every legal US resident 18 years of age and older (at the time of entry) who are full-time employees of real estate agencies, home building companies, licensed certified public accountants, or licensed attorneys at the time of entry. Employees of Evolve Bank & Trust, its subsidiaries affiliates, promotion or advertising agencies, family members, and persons living in the same household of such employees are not eligible. Void where prohibited. PRIZES Every Monday three gift cards in the amounts of $75, $50, and $25 will be awarded to the eligible participants with the most correct, second most correct, and third most correct selections, respectively. In the event of a tie, a tie-breaker drawing will occur. GRAND PRIZE DRAWING A drawing for $2,500 in the form of a gift card value awarded to three participants will occur after the final game of the 2023-2024 regular NFL football season from all eligible entries received. OTHER TERMS AND CONDITIONS 1) No purchase or online access fee is necessary. 2) Void where prohibited by law. 3) By entering this Contest entrants agree to abide by all terms of the official rules and the Sponsor’s decisions made in its sole discretion which shall be final. 4) Sponsor is not responsible for unclaimed, misdirected, lost, late, illegible, forged, destroyed, incomplete, or entries not otherwise in compliance with the official rules. Such entries will be disqualified. 5) Any taxes for the prize are the winner’s responsibility. 6) Each winner by acceptance of a prize agrees to release the Sponsor its parent-subsidiary and affiliated businesses and each of their offices, directors, shareholders, employees, advisors, accountants, attorneys, assignees, agents, licensees, representatives and any other person or entity associated with this Contest from all liability claims or actions of any kind whatsoever, which may be sustained in connection with the receipt, enjoyment, ownership, or use of the prize. 7) By entering the Contest each entrant agrees that (i) any and all disputes, claims, and causes of action arising out of or in connection with the Contest or any prizes awarded shall be resolved individually, without resort to any form of class action, (ii) all claims, judgments, and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering the Contest but in no event will attorneys failure to receive entries due to any cause, including human transmission or technical problems, failures, or malfunctions of any kind whether originating with sender, with Sponsor, or otherwise that may limit an entrant’s ability to participate in the Contest, (iii) any injury or damage resulting from participation in the Contest and or the use or misuse of any prize (including without limitation claims, costs, injuries losses and damages related to person injuries, death, damage to loss or destruction of property, or any claims, costs, injuries, losses or damages related to or based on the entrant’s rights of publicity or privacy or the entrant’s claim that he has somehow been defamed or portrayed in a false light). 8) Sponsor does not assume any responsibility for any schedule changes in the contest timeline including without limitation scheduling conflicts, labor strikes, Acts of God, and other unforeseen events that disrupt the contest schedule. Sponsor reserves the right to cancel, modify, or suspend the Contest as Sponsor and may determine in its sole discretion. 9) All issues and questions concerning the construction, validity, interpretation, and enforceability of these official rules or the rights and obligations of entrants or Sponsor in connection with Contest shall be governed by and construed under the internal laws of the participating states without giving effect to any conflict of law, rules, or provisions that would cause the application of any other state’s laws. The invalidity or enforceability of any provision of these rules shall not affect the validity or enforceability of any other provision. If any provision is determined to be invalid or otherwise unenforceable or illegal these rules shall otherwise remain in effect and shall be construed in accordance with their terms as if the invalid or illegal provisions were not contained herein. Each person who participates in the Contest irrevocably agrees that the state and federal courts shall have exclusive jurisdiction over any suit or other proceeding arising out of or based upon this agreement and each hereby waives any claim that is not subject personally to the jurisdiction of said courts or that any such suit or other proceeding is brought in an inconvenient forum or improper venue.
