Special Needs Trusts
Evolve offer trusts that allow people with disabilities to receive assets for their benefit without compromising eligibility for government assistance.
Two different types of special needs trusts are available:
Self Settled Trust
This trust is self-funded by the person with a disability. When the trust terminates, any remaining funds in the Self-Settled Trust must be used to repay the state for any Medicaid benefits the person received during his or her lifetime.
This trust is funded with assets from someone other than the beneficiary, such as a parent, and can be created by will, revocable living trust, or as a standalone trust. Trusts funded by a third-party do not require a payback to the state for benefits received.
Personal Trusts (Revocable & Irrevocable)
Revocable Trusts: Provisions can be altered or canceled pending the grantor or originator.
Irrevocable Trusts: Trust terms are set and cannot be altered by the grantor.
Charitable Remainder and Lead Trusts
Charitable Remainder Trust disperses income to non-charitable beneficiaries over time before allocating the remainder of the donated assets to charity at a preselected future time.
Charitable Lead Trust is the reverse of a charitable remainder trust. This type of trust disperses income to a named charity, while the non-charitable beneficiaries receive the remainder of the donated assets at a preselected future time.
Generation Skipping Trusts
Generation Skipping Trusts are designed to pass assets over multiple generations in a tax efficient manner.
Asset Protection Trusts
Evolve provides strong protection from creditors, lawsuits, or any judgments against your estate. Asset protection trusts allow you to protect your assets from future creditors.
Estate Settlement Services
Evolve will guide you through closing out personal and financial affairs of an estate.
Guardianship and Conservatorship Services
Evolve serves as guardian and conservator for the financial assets of an individual in order to preserve, grow and account for those assets, including satisfying all Court monitoring requirements.
